FAQs about eSign Disclosure
What is eSign Disclosure?
eSign Disclosure, or an eDisclosure, is an agreement which is provided to the signer (consumer) by the requester (business) stating they agree to have their documents transmitted and received electronically. It also includes the signer's rights regarding if they later withdrawal their consent and any consequences of this decision.
Why does eSign Disclosure exist?
The "Electronic Signatures in Global and National Commerce Act" (eSign act of 2000) specifies in section 101 subsection C that the signer (consumer) "consent electronically, in a manner that reasonably demonstrates that the consumer can access information in the electronic form that will be used to provide the information that is the subject of the consent".
Should I enable eSign Disclosure?
Typically this is necessary if your company is a Business to Consumer company. However, Dropbox Sign does not provide specific legal advice as to whether using an eSign disclosure is necessary. We recommend that you check with your own legal team for specific advice.
What will signers see if I enable eSign Disclosure?
The first time a signer opens a signature request from a member of your team, they’ll see a checkbox next to the Get Started button prompting them to agree to your electronic records and signature agreement. Once they check the box, they won’t see the prompt again on any future signature requests from members of your team and the audit trail of the original signature request will include the date and time they checked the box.
